1. Acceptance of Terms

By accessing or using the Contrast Collective platform, website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Contrast Collective ("we," "us," or "our").

Your continued use of the Service following any modifications to these Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically.

2. Description of Service

Contrast Collective is a private booking and suite management platform for contrast therapy experiences, including sauna (dry heat) and cold plunge (cold water immersion) sessions. The Service allows users to discover available locations, reserve private suites, manage bookings, and access wellness protocols designed around thermal contrast therapy.

Sessions take place in private, staffed or unstaffed facilities. The specific amenities, session durations, and pricing vary by location. All bookings are subject to availability and the policies of the individual location.

3. User Accounts & Eligibility

To use the Service, you must create an account. You represent and warrant that:

  • You are at least 18 years of age. Minors are not permitted to use the Service.
  • All registration information you provide is accurate, current, and complete.
  • You will maintain the accuracy of your account information and promptly update it as needed.
  • You are responsible for all activity that occurs under your account.
  • You will keep your login credentials confidential and not share account access with others.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used in a manner inconsistent with the purpose of the Service.

4. Booking & Cancellation Policy

All bookings are subject to real-time availability. When you complete a booking, you are reserving exclusive access to a private suite for the scheduled time. You are responsible for arriving on time; late arrivals do not extend your session end time.

Our cancellation policy is based on how far in advance you cancel before your scheduled session start time:

  • 24 hours or more before your session: 100% refund issued as points (1 point = $1) — usable on any future booking.
  • Less than 24 hours before your session: a 50% cancellation fee applies. You will receive a 50% refund as points.
  • After your session start time (including no-shows): no refund is available.

All refunds are issued as points credited to your Contrast Collective account, regardless of how the original booking was paid. Points appear in your balance immediately and can be used on any future session. We do not issue refunds back to a credit card.

We reserve the right to cancel or reschedule sessions due to facility maintenance, equipment failure, or other circumstances beyond our control. In such cases, you will be offered a full refund or credit at your discretion.

5. Payment Terms

Payment is required at the time of booking. We accept major credit cards and other payment methods presented at checkout. All prices are displayed in US dollars unless otherwise noted, and are subject to change without notice. Applicable taxes will be calculated and added at checkout.

Membership and subscription plans are billed on a recurring basis (weekly, monthly, or annually, as selected). You authorize us to charge your payment method on file for each billing period. You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period unless otherwise stated.

All sales are final except as described in our cancellation policy above. Chargebacks initiated without first contacting us to resolve the issue may result in account suspension.

6. Health & Safety Disclaimer

Contrast therapy — the alternating use of sauna (high heat) and cold plunge (cold water immersion) — involves deliberate exposure to physiological extremes. While many people experience significant wellness benefits, these activities carry inherent risks, including but not limited to:

  • Dizziness, lightheadedness, or fainting due to rapid changes in body temperature or blood pressure.
  • Cardiovascular stress, including increased heart rate and blood pressure changes.
  • Burns, hypothermia, or heat exhaustion in cases of overexposure.
  • Adverse reactions for individuals with pre-existing medical conditions.

You should consult a qualified physician before using the Service, particularly if you have or suspect you may have any cardiovascular condition, respiratory condition, diabetes, epilepsy, pregnancy, or any other medical condition that may be affected by temperature extremes.

By using the Service, you acknowledge that you understand these risks and voluntarily assume all inherent risks associated with contrast therapy. Contrast Collective does not provide medical advice, and nothing in the Service should be construed as such.

7. Liability Waiver

Prior to your first session, you will be required to review and electronically sign a liability waiver. This waiver is a condition of access to any Contrast Collective facility and is legally binding upon execution. By signing the waiver, you agree to release Contrast Collective, its affiliates, owners, officers, employees, and agents from any and all claims, damages, or liability arising from your use of the Service, including personal injury, property damage, or death, to the fullest extent permitted by applicable law.

The waiver is maintained on your account and remains in effect for all future sessions unless revoked in writing. Failure to complete the waiver will result in denial of access to the facility.

8. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, images, wellness protocols, software, and user interface design, is the property of Contrast Collective or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Service without our express written permission.

You retain ownership of any content you submit to the Service (such as profile information or feedback). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content in connection with operating and improving the Service.

9. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorized access to any portion of the Service or its related systems.
  • Reverse engineer, decompile, or disassemble any software component of the Service.
  • Use automated tools (bots, scrapers, crawlers) to access, query, or collect data from the Service.
  • Resell, sublicense, or otherwise transfer access to the Service to any third party without our written consent.
  • Engage in any conduct that restricts or inhibits any other user from using or enjoying the Service.

10. Termination

We reserve the right to suspend or permanently terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, suspected fraudulent or abusive activity, or non-payment of fees owed.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination — including Liability Waiver, Intellectual Property, and Governing Law — shall survive any termination or expiration of these Terms.

11. Changes to Terms

We may revise these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you via email or an in-app notice. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

12. SMS Program Terms

Program description. Contrast Collective operates two separate SMS streams. They are governed independently.

(a) Sign-in verification (transactional, user-initiated). When you enter your phone number into our sign-in form, we send a one-time verification code and any two-factor authentication code to that number so you can log in. These messages are sent only in direct response to your sign-in attempt. They are not part of our A2P campaign program and do not require, and are not affected by, the opt-in described in (b) below. You can avoid sign-in SMS entirely by signing in with email instead — email is a fully supported alternative, and providing a phone number is optional.

(b) Booking notifications program (A2P, opt-in required). After affirmatively opting in, you may receive transactional SMS about your own bookings from Contrast Collective: booking confirmations, reschedule and cancellation notices, suite door access codes, and customer-service replies. We do not send promotional or marketing SMS through this program.

How to opt in to the booking notifications program. Provide a phone number and check the unchecked "Send me booking SMS notifications" box on our sign-up or booking form at https://contrast-collective.com, or enable the same toggle at any time on your account notifications page. Checking the box is optional and is not required to create an account, sign in, book sessions, attend sessions, or use any other feature of Contrast Collective.

How to opt out of the booking notifications program. Reply STOP to any booking notification at any time. You will receive a confirmation message and no further booking notifications will be sent. To re-subscribe, reply START. Opting out of booking notifications does not affect your ability to receive sign-in verification codes when you request them by signing in with your phone number.

How to get help. Reply HELP to any message, or email support@contrast-collective.com.

Message frequency. Frequency varies based on your account activity. If you have opted in to booking notifications, expect a message around each booking, reschedule, cancellation, and session reminder. Sign-in verification messages are sent only when you actively sign in using your phone number.

Cost. Message and data rates may apply. Contrast Collective does not charge for messages, but your mobile carrier may.

Supported carriers. Compatible with all major US carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Cricket, and others. Carriers are not liable for delayed or undelivered messages.

Privacy. See our Privacy Policy. Mobile phone numbers and SMS opt-in consent data are not shared or sold to any third parties or affiliates for marketing or promotional purposes.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas, and you consent to personal jurisdiction in those courts.
